In today’s digital age, while online learning has made education more accessible, it has also raised issues around the misuse of paid content. Some students engage in certain illegal activities such as the unauthorized sharing, selling, or recording of copyrighted course material. One may do it simply to share costs or to help others, and while it may seem harmless, it can lead to serious consequences for you.
Our team comprises of hard working human beings (not bots) and we work very hard to provide our students the best & most GATE relevant content and support. So it is our responsibility to take strict legal action against anyone who tries to directly / indirectly disrupt livelihood of our team.
Let’s understand why engaging in such activities is not only unethical but can also result in legal trouble.
What kind of sharing is not allowed in Exergic
All of the course content and course structure, we offer is protected by copyright laws and is the exclusive intellectual property (IP) of Exergic. This includes all our course videos, learning materials, questions and tests. It is illegal to copy or re-transmit any content, in whole or in part, using any method, including photocopying, recording, mechanical duplication, taking pictures or other means. Any selling, recording, resale, or distribution of the content (whether it be online, on video, or in print) is illegal and punishable under law. Furthermore, trying or attempting to sell or replicate our course material using methods such as (but not limited to) taking screenshots or capturing the screen is also illegal and punishable under law. Terms of use are clearly mentioned in the website. You can refer to those for more clarity. And anyone who purchases any course content, agrees to those Terms and Conditions legally.
What are the legal consequences
We have a zero tolerance policy regarding course content security. We actively monitor misuse of course content and take legal action if we detect unauthorized sharing. When someone engages in course sharing or piracy attempts, it violates our Terms and Conditions and hence it is both Civil and Criminal offense.
According to Section 63 of the Indian Copyright Act, 1957, copyright infringement is a criminal act and it can result in up to three years of imprisonment or a fine of up to ₹200,000. In addition to this, we also file Civil cases where we claim additional damages up to ₹ 5 lacs.
All such cases will affect the career of such offenders badly.
Legal cases we have filed
In spite of several warnings, there have been instances where individuals have attempted to illegally breach our terms of use.
We would particularly highlight a learner who violated copyright laws by sharing and selling course materials without permission. Despite warnings, he continued illegal activities of course sharing and attempts to pirate the course.
As a result, we initiated legal action and informed his family and college about his illegal actions.
Currently, the learner is facing a case of copyright infringement and forgery.
